Jiraffe Privacy Policy

In Brief

Personal data is information that can be used to help identify an individual, such as name, address, phone number or email address.

Jenx Limited is required to process the personal data of individuals (also known as “data subjects”) as part of its business practices. Individuals can include (but are not limited to) customers, suppliers, business contacts, clients and any other individuals we have a direct or indirect relationship with.

Terminology and Definitions

This policy describes the measure taken by Jenx Limited (Company No 01808921) (trading as Jiraffe in the UK) to comply with the 2018 Data Protection Act, which is the UK’s implementation of the General Data Protection Regulation (GDPR).

The term “personal information” is defined as any information relating to an identified or identifiable living person.

Such an identified or identifiable living person is referred to as a “data subject”.

The data subject may be identified directly or indirectly by any of the following data:

  • Name;
  • Identification number;
  • Location data;
  • Email address or other online identifier; or
  • One of more factors specific to their physical, physiological, genetic, mental, economic, cultural or social identity.

The term “processing” in this policy relates to any of

  • Obtaining, recording or holding information in any format and on any media;
  • Carrying out any operation or set of operations on the information including accessing, storing, retrieving, communicating, disclosing, erasing or destruction.

The term “data controller” applies to an organisation who  is responsible for deciding how personal data is processed and protecting it from harm.

Controllers can delegate the processing of personal data to other organisations known as data processors, but the responsibility for keeping it safe  still rest with the controller.

 

Introduction

This privacy policy sets out how Jenx Limited uses and protects any personal data from people outside of the Company with regard to the collection, storage, access  and processing of such information under the Data Protection Act 2018, which includes the UK implementation of the General Data Protection Regulations.

Jenx Limited are committed to ensuring that your privacy is protected. We are committed not only to the letter of the law, but also to the spirit of the law. We place the highest importance on the correct, lawful, and fair handling of all personal data, respecting the legal rights, privacy, and trust of all individuals we deal with.

Jenx Limited trades as Jiraffe within the UK and this policy applies to all our dealings, including those under the Jiraffe brand.

 

The personal information we process from data subjects outside the Company

We collect process and store contact information from existing customers under the legal basis of fulfilling our contractual obligations;

We collect process and store contact information from suppliers and retailers under the legal basis of fulfilling our contractual obligations;

We collect process and store contact information from prospective and existing customers for marketing purposes under the legal basis of legitimate interests, informed by a legitimate interests assessment, unless informed that these data subjects do not wish us to do so;

Where we use other personal information e.g. images for promotional purposes, we will only do so with explicit consent which may be withdrawn at any time.

We keep records of all information types collected, the legal basis for doing so in order to meet our legal obligations under the Data Protection act 2018.

We do not share or sell customer information with any third parties unless required to do so by a court order or other legal measure

It is only for personal or professional use (you are a parent/carer or professional seeking information about the use of a piece of equipment)

The case history is not changed in any way

Images must not be separated from accompanying text.

Further written consent MUST be sought if:

  • Information is to be used by Jenx Limited’s business partners for commercial purposes (marketing brochures, website, advertising etc.)
  • The format of the case history is changed, for example making your own version to present to colleagues
  • The case history is to be translated.

Jenx Limited is committed to only contacting individuals for marketing purposes if they have a genuine interest in our products.

Jenx Limited has carried out a legitimate interests assessment to determine that we use legitimate interest as the legal basis for processing the personal information of those who express an interest in our products or purchase products from us.

You may object to any direct marketing you receive from Jenx Limited at any time. Where Jenx Limited receives an objection to direct marketing, we will cease all processing of your personal data for these purposes regardless of time, and without delay or charge.

The right to Erasure

Under the 2018 Data Protection Act, as a data subject you may have the right to have your personal data erased. This is also known as ‘the right to be forgotten’.  This right is not absolute and is only applicable in certain circumstances.

You have the right to erasure if:

  1. the personal data is no longer required for the purpose(s) which we collected or processed it;
  2. we are processing the information under the lawful basis of consent for holding the data you withdraw consent;
  3. we are relying on the lawful basis of legitimate interests to process the data, either for direct marketing, or when have no overriding legitimate interest to continue this processing;
  4. we have processed the data unlawfully; or
  5. it is a requisite for legal compliance that we do so.

The Right to Restrict Processing

The right to restrict processing gives individuals the ability to limit the way Jenx Limited uses their data normally whilst another request or complaint is investigated

You may request the restriction of processing due to issues within the information we hold about you or if you have an issue with how we have processed your data.

In most cases, restrictions on processing are temporary, but they will need to be in place for a certain amount of time and will not be lifted until we have notified you.

The Right to Data Portability

This right allows you to obtain and reuse personal data for your own purposes across different services. This right entitles you to move, copy or transfer personal data from one IT environment to another without hindrance to usability.

  1. This right only applies:
  2. to personal data you have provided to us;
  3. where processing is based on consent or the performance of a contract; and
  4. when processing is carried out by automated means.
  5. Where requests are granted, Jenx Limited will provide data in an open and commonly used machine-readable format which allows the data to be used by other organisations.
  6. Where requested (and technically feasible) we will transmit the data directly to another organisation/data controller.

The Right to Object

This right gives you the ability to object to specific processing activities carried out by Jenx Limited. Unlike the right to restriction, objections are usually permanent in nature.

You have the right to object to:

  1. direct marketing (including profiling) in all forms
  2. processing for purposes of scientific/historic research and statistics
  3. processing based on legitimate interests or the performance of a task in the public interest/exercise of official authority (including profiling)

Where Jenx Limited receive an objection to processing for purposes of direct marketing, Jenx limited will cease all processing of the subjects personal data for those purposes regardless of time, and without delay or charge. We have no grounds to refuse or challenge an objection to processing for the purposes of direct marketing.

Rights in relation to automated decision making & profiling

Jenx Limited does not use automated decision making (including profiling) in any of its current practices.

Jenx Limited will undertake a thorough Data Protection Impact Assessment, including a review of this policy prior to engaging in any automated decision making or automated profiling activities.

Data Breach Notification

If a personal data breach occurs and that breach is likely to result in a risk to the rights and freedoms of Individuals (“data subjects”) (e.g. financial loss, breach of confidentiality, discrimination, reputational damage, or other significant social or economic damage), jenx limited has place policy and procedural measures to inform the Information Commissioner’s Office of the breach without delay, and in any event, within 72 hours of Jenx Limited becoming aware of it.

In the event that a personal data breach is likely to result in a high risk (higher than stated above) to the rights and freedoms of individuals, Jenx Limited will ensure that all affected are informed of the breach directly and without undue delay.
